Object of the Terms

These general Terms & Conditions of Use ("T&Cs") govern your access to and use of the SammyT mobile applications (the "App"). By downloading, installing, or using the App, you expressly and unreservedly accept these T&Cs and agree to abide by them.

1. Acceptance of Terms

By accessing or using the App in any manner, you agree to these T&Cs, our Privacy Policy, and any additional guidelines or policies posted within the App. If you do not agree with any part of these T&Cs, please discontinue use immediately.

2. Legal Information

The App is operated by SammyT, a company incorporated under French law, with registered office in Paris, France.

Host: OVH Cloud.
Data Protection Officer: appointed in accordance with French law and GDPR.

3. Eligibility

The App is available to anyone who has the legal capacity to enter into binding contracts. If you are considered a minor under your local laws, you must obtain parental or guardian consent before using the App. By using the App, you represent that you meet these eligibility requirements.

4. Account Registration

To access certain features, you may register for an account ("Account"). You agree to:

• Provide accurate, current, and complete information.
• Keep your credentials secure and confidential.
• Notify us immediately of any unauthorized use of your Account.

We reserve the right to suspend or terminate Accounts that violate these requirements.

5. Use of the App

Permitted Uses:

• Accessing features, resources, and community functions.
• Communicating with other users per our Community Guidelines (section 14).

Prohibited Uses:

• Any unlawful or unauthorized activity.
• Reverse-engineering or tampering with the App's software.
• Disrupting or degrading App performance.
• Using automated tools to scrape or collect data.

6. Intellectual Property

All content, trademarks, logos, and software in the App are owned by SammyT or licensed to us. You may not reproduce or create derivative works without our prior written permission.

7. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and share your information. By using the App, you consent to those practices and any updates made to the Policy.

8. Cookies

We use cookies and similar technologies to enhance your experience. Our Cookie Policy explains the types of cookies we use and how to manage them.

9. Hypertext Links

The App may contain links to third-party websites. SammyT does not control or endorse these external resources and is not liable for their content or practices.

10. Subscriptions & Billing

Certain features require a paid auto-renewable subscription ("Premium Subscription"). Subscription titles, durations, and prices are displayed in the App before any purchase; prices may vary by region and are shown in your local currency. By subscribing, you agree to the following:

• Payment is charged to your App Store or Google Play account at confirmation of purchase.
• Where a free trial is offered, the subscription begins at the end of the trial unless cancelled at least 24 hours before the trial ends.
• Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your device's App Store or Google Play settings; deleting the App does not cancel a subscription.
• Refunds are handled by the applicable store under its policies.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SAMMYT DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, SAMMYT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

13. User Content

You are responsible for all content you upload or share through the App. You agree not to submit content that is unlawful, infringes others' rights, or contains harmful code. By submitting content, you grant SammyT a non-exclusive, royalty-free license to use, modify, and display it for the purpose of operating the App.

14. Community Features, Objectionable Content and Abusive Users

Certain Apps offer community spaces where users can publish posts, react, or exchange with one another ("Community Features"). Access to Community Features is conditioned on your acceptance of this section, requested within the App before first use.

No tolerance for objectionable content or abusive users

Objectionable content and abusive behavior are not tolerated in any form. When using Community Features, you must not publish, share, or transmit content that:

• breaks the law, threatens, defames, harasses, or intrudes on anyone's private life;
• is pornographic, sexually explicit, obscene, or in any way harmful to minors;
• encourages violence, hatred, or discrimination against any person or group;
• deceives others, including scams, spam, chain messages, or unsolicited promotion;
• passes you off as another person or falsely claims an affiliation;
• infringes intellectual property or any other right of a third party.

Directing harassment, threats, intimidation, or bullying at another user constitutes abusive behavior and is prohibited on the same terms.

Moderation, reporting and blocking

Every piece of user content in the App carries a reporting function, and every user can be blocked. Blocking a user immediately removes their content from your experience and prevents further interaction between you.

We review reports within 24 hours of submission. Depending on the finding, action may include removing the content, warning the author, suspending the account temporarily, or terminating it permanently. We may also monitor, moderate, or remove any user content at our own initiative, at our sole discretion and without prior notice.

An account terminated for violating this section is not entitled to any refund of subscription fees.

How to report

Use the in-app report function attached to the content or user concerned, or write to us at sammy.teillet@gmail.com describing the content and where it appears.

15. Liability & Force Majeure

The App is available 24/7 except during maintenance or force majeure events beyond our control. SammyT is not liable for interruptions, delays, or damages caused by such events.

16. Governing Law & Dispute Resolution

These T&Cs are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the courts of Paris, France.

17. Updates to the T&Cs

We may modify these T&Cs at any time by posting a revised version in the App. Your continued use after changes indicates your acceptance of the updated T&Cs.
